2. Hosting and server logs
The website is delivered via Cloudflare Pages, a service of Cloudflare, Inc., 101 Townsend Street, San Francisco, CA 94107, USA, with its European establishment Cloudflare Germany GmbH, Rosental 7, 80331 München. When a page is accessed, Cloudflare processes technically necessary data: IP address, date and time, page accessed, amount of data transferred, browser and operating system. This data is needed to deliver the page and to protect it against attacks. The legal basis is our legitimate interest in the secure and fast operation of the website, Art. 6(1)(f) GDPR. Cloudflare is certified under the EU-US Data Privacy Framework, and the EU standard contractual clauses apply in addition. Further information: cloudflare.com/privacypolicy.
3. No cookies, no analytics
We set no cookies and use no analytics or advertising services. Fonts, images and scripts are on our own server. The only thing your browser remembers locally is the season selected at the prices (local storage, key “mbc-saison”), so that the prices are right straight away on your next visit. No personal data is stored or transmitted to us in the process. You can delete the entry at any time in your browser settings.
4. Enquiry by form, e-mail or phone
If you contact us via the enquiry form, by e-mail or by phone, we process the details you give us: name, e-mail address, phone number if you provide it, preferred date, number of people, boat and your message. The form sends the details encrypted to our hosting service Cloudflare (section 2), which forwards them to us as an e-mail and sends you a copy. Cloudflare also stores the enquiry for us in a database located in the EU so that we can process and confirm it and keep the availability calendar; the public calendar only shows whether a day is free or booked, never names. For sending e-mails we use Resend (Resend, Inc., 2261 Market Street, San Francisco, CA 94114, USA), the transfer is safeguarded by the EU-US Data Privacy Framework and standard contractual clauses; Resend stores the mails only for delivery and short-term logs. To protect against automated input, Cloudflare Turnstile checks on submission whether a human is filling in the form; in doing so, technical characteristics of the browser are transmitted to Cloudflare, without cookies and without you having to solve anything. The legal basis for this is our legitimate interest in a working, spam-free form, Art. 6(1)(f) GDPR. We use the data exclusively to answer your enquiry and to handle a charter, a course or the chartering out of a yacht. The legal basis is the initiation and performance of a contract, Art. 6(1)(b) GDPR. We store the data for as long as the enquiry is ongoing and afterwards for as long as retention periods under tax and commercial law require.
5. WhatsApp
On the website you find links that open a message to us in WhatsApp. Only when you click the link and send the message does WhatsApp Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland, process your data under WhatsApp's rules. We then see your phone number, your profile name and your message and use them only to reply to you. The legal basis is Art. 6(1)(b) GDPR. 6. Links to Google
The reviews and the location are included as links to Google Maps, not as an embedded map. Only when you click such a link do you leave our website and Google processes your data under its rules.
7. Disclosure of data
We do not pass your data on to third parties unless it is necessary for processing, for example to the German Sailing Association (DSV) to register for an exam, to our tax adviser, or because we are legally obliged to. Transfers to third countries take place only via the hosting service under section 2 and the e-mail sending under section 4.
8. Your rights
You have the right of access to your stored data, to rectification, erasure, restriction of processing and data portability, as well as the right to object to processing based on legitimate interests. To do so, write to us at info@mallorca-bootcharter.de. You can also complain to a supervisory authority, in Spain to the Agencia Española de Protección de Datos (aepd.es), in Germany to the data protection authority of your federal state.
9. Data security
The website is delivered exclusively encrypted via HTTPS. E-mails to us are transmitted with transport encryption, as far as your provider supports it.
